This Terms of Service document (“Terms”) sets out the terms of use for Hideyourhosting's services (“Service” or “Services”) provided by the Hideyourhosting project (“Hideyourhosting”). These Terms also govern your use and access to Hideyourhosting Content (“Content”), which includes the Hideyourhosting.com website (“Site”), applications (“Applications”), and any software provided by Hideyourhosting (“Software”).

By agreeing to these Terms, you also agree to the Privacy Policy ("Privacy Policy").

Acceptance

By accessing the Content or Services, you agree on behalf of yourself or those you represent (“you”) to comply with and be legally bound by these Terms in their entirety. These Terms constitute a legally binding agreement ("Agreement") between you and Hideyourhosting. If you do not agree with any part of the Terms, you cannot use our Services.

By creating an account to use our Services, you are confirming that you are at least eighteen (18) years of age.

Modification

Hideyourhosting may update the Terms from time to time without notice. If you continue to use Hideyourhosting's Services, Content, Site, Apps or Software after these changes take effect, you agree to the revised Terms. The current version of the Terms is available on the Site. You understand and agree that it is your responsibility to review these Terms from time to time in order to be aware of the current rules and obligations. Notification of any major changes to the Terms will be provided to subscribers via email or updates on the Site. Your use of the Content or Services following the posting of changes to these Terms constitutes your acceptance of the amended Terms.

Privacy Policy

Subscriptions

Hideyourhosting services are available to you without registering on the Site. By subscribing to the Services, you agree to become a subscriber ("Subscriber") for the period you choose. A complete list of subscription plans and prices is available on the Site. Hideyourhosting reserves the right to change the subscription fee or introduce a new fee at any time after prior notice posted on the Site or sent by email. Any price changes will not affect the current Subscriber's subscription period and will take effect upon renewal. Subscription purchases and refunds are handled through several third party payment companies.

Acceptable Use Policy

The Hideyourhosting Services can be accessed from all over the world, so it is your responsibility to assess whether your use of the Site, Apps, Software or Services complies with local laws and regulations. When you use the Site, Applications, Software or Services, you must comply with these Terms and applicable laws, regulations and policies.

You understand that it is your responsibility to maintain the confidentiality of your Hideyourhosting account information. You are responsible for all activities under your account. If you ever discover or suspect that someone has accessed your account without your permission, you are advised to inform us immediately so that we can revoke your account credentials and release new ones.

Hideyourhosting is committed to providing the best service to all of our subscribers. In this sense, we require that you do not abuse our Content or Services. Misuse means any use, access to, or interference with the Content or Services contrary to the Terms or applicable laws and regulations.

To protect the Services from misuse or harm to anyone, Hideyourhosting reserves the right to take appropriate action when our Services are used in violation of these Terms and applicable law. You agree that Hideyourhosting may terminate your account without refunding the Services already paid for if you misuse it.

By using our Services, you agree not to:

Send or transmit unwanted advertisements or content (eg, "spam") through the Service.
Submit, publish or transmit through the Service any content that is illegal, hateful, threatening, offensive or defamatory; violates intellectual property rights; invades privacy; or incites violence.
Upload, download, publish, reproduce or distribute any content protected by copyright or any other proprietary right without the prior permission of the owner of that content.
Upload, download, post, reproduce or distribute any content that includes sexual or explicit depictions of minors.
Engage in any behavior that restricts or prevents any other Subscriber from using or using the Service.
An attempt to access, probe, or connect to computer devices without proper authorization (ie any form of "hacking").
Attempt to compile, use or distribute a list of IP addresses that Hideyourhosting operates in conjunction with the Service.
Use the Service for anything other than lawful actions.

License

Subject to your compliance with these Terms, Hideyourhosting grants you a non-exclusive and limited license to download and use the Software. Modification, distribution to unauthorized parties, reverse engineering, or other use of the Software in any manner not expressly authorized by Hideyourhosting is strictly prohibited.

Use of any material subject to Hideyourhosting's intellectual property rights is prohibited unless Hideyourhosting's express written consent has been provided.

Language and translation of content

All of our materials were originally written in Russian. Any translation of our Content is done to the greatest extent possible. We cannot guarantee the accuracy of the translated Content. In the event of any discrepancy between the translated Content and the Russian Content, the Russian Content shall prevail.

Third party websites

Hideyourhosting may provide you with content owned by Third Parties (“Third Parties”) or links to third party websites. Hideyourhosting is not responsible for the availability of content provided by Third Parties as they are not under Hideyourhosting's control or supervision and may have different terms of use and policies. Your access through our Services to any website, service or content provided by Third Parties does not indicate any relationship between Hideyourhosting and such Third Parties.

Disclaimer

We will strive to prevent disruptions to the Site and Services. However, they are provided on an "as is" and "as available" basis and we do not guarantee, directly or indirectly, the accuracy of any materials or information provided through the Site or Service, or their suitability for any particular purpose. We expressly disclaim all warranties of any kind, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose or non-infringement. We do not make any guarantees that the Services will meet your requirements, or that they will be uninterrupted, timely, safe or error-free, or that defects, if any, will be corrected. You acknowledge that you are accessing the Site and the Services at your own risk and discretion.

Server coverage, speed, server locations, and quality may vary. Hideyourhosting will do its best to make the Service available at all times. However, the Service may not be available due to a number of factors beyond our control, including, but not limited to, emergencies; crashes of third-party services; or problems or limitations of transmission, equipment or network, interference or signal strength; and can be interrupted, rejected, limited or shortened. We are not responsible for data, messages or pages that are lost, undeliverable, delayed or misdirected due to interruptions or performance problems of the Service, communication services or networks. We may impose restrictions on use or service, suspend service, terminate accounts, or block certain uses in our sole discretion to protect subscribers or the Service. The accuracy and timeliness of the data received is not guaranteed; there may be delays or gaps.

Hideyourhosting reserves the right to investigate cases that we consider to be a violation of these Terms. We may, but are not obligated, in our sole discretion and without notice, to remove, block, filter or limit by any means any material or information that we believe to be actual or potential violations of the restrictions set forth in these Terms and any other action that may incur the liability of Hideyourhosting or our customers. Hideyourhosting disclaims any responsibility for any failure on our part to prevent the transmission of such material or information through the Service and / or to your computer device.

Limitation of Liability

Hideyourhosting is not responsible and accepts no liability to any Subscriber or other person for any loss or damage that you suffer in the event of:

any failure or interruption of the Site or Service;
any act or omission of any Third Party involved in providing you with access to the Site or Service or the data contained therein;
any other reason related to your access or use, or inability to access or use any part of the Site or its Content;
your interactions on the Site or Service;
your failure to comply with this Agreement;
the cost of acquiring replacement goods or services; or unauthorized access or alteration of your transmissions or data, regardless of whether the circumstances leading to such a reason were under the control of Hideyourhosting or any vendor providing software, services, or support for the Site or Service.

Under no circumstances will Hideyourhosting, its partners, affiliates, subsidiaries, members, officers or employees be liable for any direct, special, indirect, consequential or incidental loss, or for any other loss or damage of any kind, even if they was notified of the possibility of such. The foregoing does not apply in cases prohibited by applicable law.

Compensation

You agree to safeguard, protect and safeguard Hideyourhosting, its officers, directors, employees, members, partners, agents and suppliers, and their respective affiliates, officers, directors, employees, members, shareholders, partners and agents from any all claims and expenses, including attorney's fees, arising from your use of the Content and Services, including but not limited to your breach of this Agreement. We may, at our sole discretion, take exclusive protection and control over any issue subject to redress from you. However, assuming such protection or control does not relieve you of any liability for damages.

Choice of law

This Agreement shall be governed by and construed in accordance with the laws of our country, excluding its conflict of laws rules.

Final provisions

If any provision of this Agreement is held invalid or unenforceable, that provision will be interpreted in accordance with applicable law to reflect the original intent of the provision, and the remainder of this Agreement will remain in full force and effect. Any failure to perform or enforce any right or provision of this agreement does not constitute a waiver of such right or provision.
